The Governor: Constitutional Position and Political Reality

Article 153 of the Indian Constitution provides that "there shall be a Governor in each State." However, the Constitution Seventh Amendment Act 1956 makes it possible to appoint the same person as Governor for two or more states. Regarding his appointment, Article 155 stipulates that the Governor of a state shall be appointed by the President of India by warrant under his had and seal. Article 156 says that the Governor shall hold office during the pleasure of the President. Subject to this provision, he shall hold office for a term of five years from the date on which he assumes his office. The Governor can resign by writing a letter of resignation addressed to the President. However, he continues to hold office till the new Governor assumes his office. Since he hold office during the pleasure of the President, no process of impeachment or any other method of removal is prescribed by the Constitution.

The Qualifications for this post are that the person should be a citizen of India and should have completed 35 years of age. He should not be a member of the Union or state legislatures and, if he is, his seat in the House falls vacant on the date on which he enters the office as Governor. He shall not hold any other office of profit. His emoluments, allowances and privileges may be determined by parliamentary laws. No criminal proceedings can be instituted against the Governor during his terms of office and no proceedings for his arrest or imprisonment can be taken by any court. Civil proceedings in respect of an act done by the Governor in his personal capacity can be instituted after the prescribed statutory notice.

GSPA - Triumph of Multilateralism, Regional Cooperation & Economic Integration

The signing of Gas Sale and Purchase Agreement, GSPA with Turkmenistan on the 23 May, 2012 marks a major step towards India's energy security. It will turn the dream of bringing natural gas from the Galkynysh field, better known by its previous name, South lolotan field in Turkmenistan into a reality. The gas will come via Herat and Kandahar in Afghanistan and Multan and Quetta in Pakistan to Fazilka in India through the 1700 km long Turkmenistan– Afghanistan–Pakistan–India, TAPI pipeline when it is complete by 2018. The pipeline will carry 90 million metric standard cubit metres, mmscm of gas per day. Of this, Afghanistan will get 14 mmscm and Pakistan and India each 38 mmscm of gas. Daniel Stein, Energy Advisor at the US Department of State said in a presentation in March this year that the pipeline alone will cost about 10 to 12 billion dollars. Besides, the development of the gas field will cost another 10 billion dollars.

Endosulfan Entangle: When Pesticide Turns Pest

The Random House Dictionary of English Language defines the word 'cynic' as a person who believes that only selfishness motivates human actions and who disbelieves in or minimizes selfless acts or disinterested points of view; and 'cynical' as showing contempt for accepted standards of honesty or morality.

The Arguments

These definitions come to mind when one reads the arguments that the Central government has made before the Supreme Court of India on the issue of banning of the pesticide endosulfan. This is in response to a petition filed by the Democratic Youth Federation of India on the ill effects of endosulfan on the environment and human life, and that it should be banned. Reporting on the proceedings in the court, J.Venkatesan of The Hindu writes on August 3: "The Centre has said that long-term use of the pesticide was unlikely to present public health concern. The Centre made it clear that endosulfan was not the reason behind health problem in Kasargod
in Kerala". The court asked the government to appoint a committee to look into the health issue and report.

This was done and The Hindu reports on August 6: "The committee's interim report said public health concern or hazard associated with the pesticide was not reported from any state barring Kerala and Karnataka".
And the Centre maintained that except in Kerala and Karnataka, no negative impact of this pesticide on crops, human and animal health or environment was reported anywhere and the ban should not be imposed in other states.

Topic: Land Forms

Different types of lands are suited to different uses. Human beings thus, use land as a resource for production as well as residence and recreation.
Land-use records maintained by land revenue department. The land use categories add up to reporting area, which is somewhat different from the geographical area. The Survey of India is responsible for measuring geographical area of administrative units in India. The difference between the two concepts are that while the former changes somewhat depending on the estimates of the land revenue records, the latter does not change and stays fixed as per Survey of India measurements.

The land-use categories as maintained in the Land Revenue are as follows:

  1. Forests: It is important to note that area under actual forest cover is different from area classified as forest. The latter is the area which the Government has identified and demarcated for forest growth. The land revenue records are consistent with the latter definition. Thus, there may be an increase in this category without any increase in the actual forest cover.

  2. Land put to Non-agricultural Uses: Land under settlements (rural and urban), infrastructure (roads, canals, etc.), industries, shops, etc. are included in this category. An expansion in the secondary and tertiary activities would lead to an increase in this category of land-use.

  3. Barren and Wastelands: The land which may be classified as a wasteland such as barren hilly terrains, desert lands, ravines, etc. normally cannot be brought under cultivation with the available technology.

  4. Area under Permanent pastures and Grazing Lands: Most of this type land is owned by the village 'Panchayat' or the Government. Only a small proportion of this land is privately owned. The land owned by the village panchayat comes under 'Common Property Resources'.

  5. Area under Miscellaneous Tree Crops and Goves (Not included is Net sown Area): The land under orchards and fruit trees are included in this category. Much of this land is privately owned.

  6. Culturable Waste-Land: Any land which is left fallow (uncultivated) for more than five years is included in this category. It can be brought under cultivation after improving it through reclamation practices.

  7. Current Fallow: This is the land which is left without cultivation for one or less than one agricultural year, Fallowing is a cultural practice adopted for giving the land rest. The land recoups the lost fertility through natural processes.

  8. Fallow other than Current Fallow: This is also a cultivable land which is left uncultivated for more than five years, it would be categorized as culturable wasteland.

  9. Net Area Sown: The physical extent of land on which crops are sown and harvested is known as net sown area.

Land-use Changes in India

Land-use in a region, to a large extent, is influenced by the nature of economic activities carried out in the region. However, while economic activities change over time, land, like many other natural resources, is fixed in terms of its area. At this stage, one needs to appreciate three types of changes that an economy undergoes, which affect land-use.

India has undergone major changes within the economy over the past four or five decades, and this has influenced the land-use changes in the country, These changes between 1960-61 and 2002-03 have been shown in Fig. There are two points that you need to remember before you derive some meaning from this figure. Firstly, the percentage shown in the figure have been derived with respect to the reporting area. Secondly, since even the reporting area has been relatively constant over the years, a decline in one category usually leads to an increase in some other category.

Three categories have undergone increases, while four have registered declines. Share of area under forest, are under non agricultural uses and current fallow lands have shown an increase. The following observations can be made about these increases:

An Appraisal of the Existing Framework of Centre-State Relations

The Constitutional scheme of governance at the Centre and in the States is provided in Part Xl (Articles 245 to 263), and Part Xl (Articles 264 to 298), with few related provisions on trade and Commerce in Part XI II and on all India Services in Part XIV. Broadly it deals with three types of relations namely (a) Legislative Relations (Articles 245-255); (b) Administrative Relations (Articles 256-263); and (c) Financial Relations (Articles 264-293). The Report is prepared following this scheme and analyzing the issues and challenges under each of the three types of Centre-State relations.

The Scheme on legislative relations is largely based on the federal principle of "subsidiary" under which what can best be administered from the Conger are kept with the Union (Union List.) and those which are more of regional or local interest are assigned to the Units (State List:) with some items at-common concern in what is called in the Concurrent list. fart XI distributes the legislative powers between the Union and the States. The subject-matter of legislation are -listed rather exhaustively in the. three Lists given in the Seventh Schedule. Constitution gives autonomy to Centre and States within their respective fields. Parliament may make laws for the whole or any part of the territory of India and the State Legislature for the whole or any part of that State. However, applying the doctrine of territorial nexus, State laws having extra-territorial operation have been held valid by the court. There are several judicial doctrines evolved by the Supreme Court to interpret possible overlapping off jurisdictions in the matter of legislative powers of Centre and States. By and large the scheme worked reasonably well, though States have complained about the Union transferring; items from the State list to the Concurrent list without adequate consultation.
